I often get asked about the legality of importing Harvoni, Epclusa or Sofosbuvir + Daclatasvir into the U.S.A. for personal use.
Big Pharma has deliberately inserted a lot of fear mongering and false information into this discussion to discourage people from choosing the much more affordable Hep C treatment option. But the reality is there is no problem getting Hepatitis C medication sent to the U.S.A. for personal use. It is only a problem if you import with the intention of re-selling.
Big Pharma’s “misinformation campaign” is designed to prevent people importing Hep C meds into the U.S.A. and this mis-information has taken many forms and is mounted on many fronts. Foremost has been the idea of fake or counterfeit medicines. Big Pharma has generated plenty of press about the risk of buying fake medicines from India and has spent a lot of money having its representatives drum this message into medical professionals like doctors and nurses.
The reality is quite different.
The real information about Harvoni and Epclusa is that since mid 2015, after communication with hundreds of people every week who have purchased Hep C meds, I have only come across two examples of counterfeit Hep C medicines being sold. Both of these came from Egypt. I am not aware of even one example of fake Hep C medicines coming out of India.
The reason for this is very simple; the licensed medicine is so relatively cheap and so easily obtained there is no reason at all for anyone to go to the trouble of making fake stuff.
Importing Harvoni or Epclusa into the U.S.A. for personal use has not been a problem since the licensed versions of these medicines became available.
Of course these is always the risk of buying online from an untrustworthy supplier however there are plenty of online Forums that will supply lists of reliable suppliers.
The point here is that I do not know any example of anyone having their medication seized or held by US Customs or FDA.
Because there has been a lot of fearmongering from Big Pharma about the issue of getting cheaper Hep C meds, I suggest that you check out the FDA’s website yourself, but below are my thoughts based on my own study of the FDA’s bulletins and my personal experience from helping many hundreds of US citizens get Hepatitis C medicines sent from India. In a nutshell there is no problem importing Hepatitis C meds into the USA if it is for personal use and I help many people every week to do this.
From the FDA Bulletin:
“FDA has a policy explaining that it typically does not object to personal imports of drugs that FDA has not approved under certain circumstances, including the following situation:”
1.The drug is for use for a serious condition for which effective treatment is not available in the United States (If you can not afford to buy it then it is not available to you. Greg)
2.There is no commercialization or promotion of the drug to U.S. residents;
3.The drug is considered not to represent an unreasonable risk;
4.Generally, not more than a 3-month supply of the drug is imported
So to summarize the situation in the USA: Since mid-2015 I have been helping people in the USA who have Hepatitis C to import Hepatitis C medicines for personal use. I have lost count of how many people in the USA I have helped but it is in the thousands. Since 2015 I have not had even one person who had their medicines, seized or blocked by Customs or the FDA. Everyone has received the meds they ordered.
So shipping Harvoni or Epclusa or Sofosbuvir and Daclatasvir to the USA can be done and is being done every day of the week and I have helped a very large number of people do this successfully, indeed with 100% success so far.
I have done this openly and my activities have been widely reported in the international and US news media.
The FDA is well aware of what I am doing and at no stage have they asked me to stop.
So there are three ways of importing Hepatitis C treatments into the USA.
The first and simplest way to buy Harvoni is to get the Gilead licensed sent from India. This is very simple and has worked many hundreds of times with no problem.
Ideally it is great if you have a supportive US doctor who will both write you a prescription and monitor your treatment however a lot of people in the USA have a problem getting their doctor to write them a prescription for Harvoni or Epclusa ( even though it is perfectly legal for doctors to do so the fear campaign mounted by Big Pharma about Hep C meds from India has had an effect) so they get the meds sent without the prescription and then ask their doctor to monitor their treatment once they start.
